A single setting decides whether the payout reaches the family within weeks, or waits months for probate to conclude. This article works through every typical case of the “who receives it?” question – factually.
A beneficiary named in the contract receives the payout directly – typically independent of probate, and unaffected by its outcome. With more than one beneficiary, the amount is divided according to the proportions set out in the contract. This is one of the product’s most important features – and the reason we recommend designating a beneficiary so strongly.
Without a beneficiary designation, the benefit typically becomes part of the estate: it goes to the heirs – under a will or the rules of statutory inheritance – but only once probate has concluded. That can mean months, while the costs of the farewell arise in the first weeks. So the money isn’t lost – only the product’s most important advantage, speed, is lost. The framework of probate is covered in the article on the estate.
The beneficiary died before the insured, and the designation wasn’t updated: the payout typically proceeds as though there were no designation – which is why the designation needs to be updated whenever life changes. The beneficiary is a minor: the payout belongs to them, but its handling is subject to legal guardianship and child-protection rules – it’s worth thinking this through in advance for such a designation. The beneficiary isn’t the same person who paid for the funeral: the insurer pays out according to the contract – settling this within the family is a separate question, best clarified in advance.
Inheritance disputes, a conflict between a will and a designation, questions of a statutory reserved share: these are the territory of inheritance law, where the rules in force and the notary handling the case, or a lawyer if needed, are the guiding authority – on specific legal questions, this site does not and cannot offer advice. On the insurance side, our job is simply this: to make sure the contract is set up so that these questions, ideally, never even arise.
